Privacy Policy

1. General

This privacy policy explains how T&N AG (hereinafter "T&N") handles your personal data. We attach great importance to protecting the personality rights of users of our products and services. We comply with the applicable data protection laws and take the necessary measures to protect your data.

The websites of other providers that can be accessed through our websites are not subject to the data protection provisions set out here. We accept no responsibility or liability for the data protection practices of third-party websites.

As a rule, T&N's websites can be used without providing any personal data. However, if a data subject wishes to use certain services offered by our company through our website, the processing of personal data may be necessary. If processing personal data is necessary and there is no legal basis for doing so, we generally obtain the data subject's consent.

Personal data, such as a data subject's name, address, email address or telephone number, is always processed in accordance with the General Data Protection Regulation (GDPR) and the country-specific data protection provisions applicable to T&N. Through this privacy policy, our company aims to inform the public about the nature, scope and purpose of the personal data we collect, use and process. This privacy policy also explains the rights to which data subjects are entitled.

As the controller, T&N has implemented numerous technical and organisational measures to ensure the most comprehensive possible protection of personal data processed through this website. Nevertheless, internet-based data transmissions may have security vulnerabilities, meaning that absolute protection cannot be guaranteed. For this reason, data subjects are free to send us personal data by other means, for example by telephone.

2. Definitions

T&N's privacy policy is based on the terminology used by the European legislator when adopting the General Data Protection Regulation (GDPR). Our privacy policy is intended to be easy to read and understand for the public, as well as for our customers and business partners. To ensure this, we would first like to explain the terminology used.

This privacy policy uses, among others, the following terms:

a) Personal data

Personal data means any information relating to an identified or identifiable natural person (hereinafter the "data subject"). A natural person is considered identifiable if they can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

b) Data subject

A data subject is any identified or identifiable natural person whose personal data is processed by the controller.

c) Processing

Processing means any operation or set of operations performed on personal data, whether or not by automated means, such as the collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Your data may also be exchanged between certain T&N companies and used by those companies for the purposes mentioned in this privacy policy.

d) Restriction of processing

Restriction of processing means the marking of stored personal data with the aim of limiting its future processing.

e) Profiling

Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

f) Pseudonymisation

Pseudonymisation means the processing of personal data in such a way that the data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.

g) Controller or data controller

The controller or data controller is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union law or the law of a Member State, the controller or the specific criteria for its nomination may be provided for by Union law or the law of a Member State.

h) Processor

A processor is a natural or legal person, public authority, agency or other body that processes personal data on behalf of the controller.

i) Recipient

A recipient is a natural or legal person, public authority, agency or other body to which personal data is disclosed, whether or not it is a third party. However, public authorities that may receive personal data in the context of a specific inquiry under Union law or the law of a Member State are not considered recipients.

j) Third party

A third party is a natural or legal person, public authority, agency or other body other than the data subject, the controller, the processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

k) Consent

Consent means any freely given, specific, informed and unambiguous indication of the data subject's wishes, in the form of a statement or a clear affirmative action, by which the data subject signifies agreement to the processing of personal data relating to them. sie mit der Verarbeitung der sie betreffenden personenbezogenen Daten einverstanden ist.

4. Collection of general data and information

Each time a data subject or an automated system accesses T&N's website, the website collects a range of general data and information. This general data and information is stored in the server's log files. The following may be collected: (1) the browser types and versions used; (2) the operating system used by the accessing system; (3) the website from which an accessing system reaches our website (known as the referrer); (4) the subpages accessed on our website through an accessing system; (5) the date and time of access to the website; (6) an Internet Protocol address (IP address); (7) the internet service provider of the accessing system; and (8) other similar data and information used to prevent danger in the event of attacks on our information technology systems.

When using this general data and information, T&N does not draw any conclusions about the data subject. Instead, this information is needed to (1) deliver the content of our website correctly; (2) optimise the content of our website and the advertising for it; (3) ensure the continued operation of our information technology systems and the technology used for our website; and (4) provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack. T&N therefore analyses this data and information, which is collected anonymously, for statistical purposes and to improve data protection and data security within our company, ultimately ensuring an optimal level of protection for the personal data we process. The anonymous data in the server log files is stored separately from all personal data provided by a data subject.

5. Subscribing to our newsletter

The T&N website gives users the option to subscribe to our company newsletter. The personal data transmitted to T&N when ordering the newsletter is shown in the input form used for this purpose.

T&N regularly informs its customers and business partners about the company's offers through a newsletter. In principle, a data subject can receive our newsletter only if (1) they have a valid email address and (2) they register to receive the newsletter. For legal reasons, a confirmation email is sent using the double opt-in procedure to the email address first submitted by a data subject for newsletter delivery. (A user who enters their email address in a mailing list through single opt-in is then given the opportunity to confirm their subscription in a confirmation email. Once the user confirms, the double opt-in process is complete.) This confirmation email is used to verify that the owner of the email address, as the data subject, has authorised receipt of the newsletter.

When a user subscribes to the newsletter, we also store the IP address assigned by the internet service provider (ISP) to the computer system used by the data subject at the time of subscription, as well as the date and time of registration. This data is collected so that any possible misuse of a data subject's email address can be traced at a later date, and therefore serves to protect the controller's legal interests.

The personal data collected when subscribing to the newsletter is used exclusively to send our newsletter. Newsletter subscribers may also be informed by email if this is necessary for the operation of the newsletter service or for a related registration, for example in the event of changes to the newsletter offering or to the technical arrangements. The personal data collected in connection with the newsletter service is not disclosed to third parties.

A data subject may cancel their newsletter subscription at any time. Consent to the storage of personal data given for the purpose of newsletter delivery may also be withdrawn at any time. Each newsletter contains a corresponding link for withdrawing consent. It is also possible to unsubscribe at any time directly on the controller's website or to notify T&N in another way.

6. Newsletter tracking

T&N's newsletters contain tracking pixels. A tracking pixel is a miniature graphic embedded in emails sent in HTML format to enable log file recording and analysis. This makes it possible to statistically evaluate the success or failure of online marketing campaigns. Using the embedded tracking pixel, T&N can determine whether and when a data subject opened an email and which links in the email they clicked.

T&N stores and analyses the personal data collected through the tracking pixels in its newsletters in order to optimise newsletter delivery and better tailor the content of future newsletters to the data subject's interests. This personal data is not disclosed to third parties. Data subjects may withdraw at any time their separate declaration of consent to this tracking, given through the double opt-in procedure. Following withdrawal, T&N will delete this personal data. T&N automatically treats unsubscribing from the newsletter as a withdrawal of consent.

7. Contact options via the website

In accordance with legal requirements, T&N's website contains information that enables users to contact our company electronically without delay and communicate with us directly. This includes a general email address.

If a data subject contacts T&N by email or through a contact form, the personal data they provide is automatically stored. Personal data that a data subject voluntarily provides to T&N is stored for the purpose of processing their enquiry or contacting them. This personal data is not disclosed to third parties.

8. Cookies

General information

T&N's websites use cookies. Cookies are text files that are stored on a computer system via an internet browser.

Many websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier for the cookie. It consists of a string of characters that enables websites and servers to associate the cookie with the specific internet browser in which it is stored. This allows the websites and servers visited to distinguish the data subject's individual browser from other internet browsers that contain different cookies. A specific internet browser can be recognised and identified by its unique cookie ID.

By using cookies, T&N can provide users of this website with more user-friendly services that would not be possible without cookies.

Cookies enable us to optimise the information and services offered on our website for the user. As mentioned above, cookies allow us to recognise users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, a user of a website that uses cookies does not need to enter their login details again each time they visit, because the website and the cookie stored on the user's computer system take care of this. Another example is a shopping basket cookie in an online shop. The online shop uses a cookie to remember the items a customer has placed in their virtual shopping basket.

Data subjects can prevent cookies from being placed by our website at any time by changing the relevant settings in the internet browser they use, thereby permanently objecting to the placement of cookies. Cookies that have already been placed can also be deleted at any time through an internet browser or other software. This is possible in all common internet browsers. If a data subject disables cookies in their internet browser, some functions of our website may not be fully available.
